Privacy Policy

This document is meant to help you understand what information we collect with Pinby and how we use it. Throughout this document, when we refer to Pinby, we're referring to our mobile application that helps you save places you discover online, created by our company, Pinby, LLC.

Privacy principles

If you read nothing else, please read this:

Information about your pins and saved lists is private. We understand the responsibility of protecting the privacy and security of this information and will do our best to uphold this.

We collect information on your usage of Pinby in order to improve the app.

Information we collect

There are a few types of information we collect. Some of it is identifiable and some is non-identifying or aggregated. Here are the types:

• User information. When you download and first start using Pinby, we ask you a few questions about who you are, your preferences, and your goals. If you choose to sign up, we will store your name and email address. You may also provide additional information to us when you contact us with a problem or question.
• Information you enter into Pinby. This includes pins you save, lists you construct, content you may add to the app, and your application preferences. When you import a place from a third-party source, we process the content and metadata from that source, such as the URL, captions, audio, text, and thumbnails to identify the places mentioned. We retain this metadata so we can show you the original source of each pin.
• Location data. Pinby is a places-based app, so every pin you save includes geographic coordinates. If you grant location permission, we use your device's location to show nearby pins and personalize your map view. We only access your location while the app is in use.
• Advertising identifiers. With your permission, we collect advertising identifiers from your device and share them with advertising partners to measure the performance of our marketing. You can control this permission in your device settings.
• Device information. When you use Pinby, we may collect information about the device you are using Pinby on, including what type of device it is, what operating system you're using, your IP address, device settings, device identifiers, and crash data.
• Pinby usage data. We collect analytics on the various actions performed by users within Pinby to help us better understand how to improve the application.

How we use your information

We use this information for the following:

• Providing the Pinby service. We use information you provide to ensure a personalized experience. This includes the places and recommendations we suggest, as well as reminders we might send you through the app, or emails we may send to notify you of important updates or offers.
• Understanding and improving the product. We have to understand how users use Pinby in order to make the product better. For this purpose we examine usage data to analyze user behaviors.
• Responding to your feedback. If you contact us with a problem or question, we will use your information to respond and address your feedback.
• Measuring our marketing. If you grant tracking permission, we use advertising identifiers and event data to measure how our ads perform and to help advertising partners show Pinby to people likely to enjoy it.

Data retention and deletion

We will retain your personal data for as long as you maintain an account with Pinby. We will also retain your personal data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. If we no longer need to retain your personal data for the above purposes, then we will delete your data from our systems.

Where permissible, we will comply with individual requests regarding data access, correction, and/or deletion. You may delete your Pinby account directly from app settings, or by contacting us at contact@pinby.app. Upon a deletion request, we permanently and irreversibly delete your personal data from our systems.

Disclosure of your information

There are specific situations when we may share user information.

• With consent. If we have your consent, we may share your information with a third-party.
• To comply with legal process. If we believe that disclosure of information is reasonably necessary to comply with a law, regulation, or legal request, we may share your information. If we receive a law enforcement or third party request for information, we will provide prior notice to the subject of the request where we are legally permitted to do so.
• With third party service providers and agents. We may employ third party companies or individuals to process user information on our behalf, based on our instructions and in compliance with this Privacy Policy. These include hosting and database providers that help us store user data and content processing providers, including AI and transcription services — that help us extract places from videos, images, and articles you import. These providers are contractually required to handle your data in accordance with this policy and are not permitted to use it for their own purposes, including to train their own models.

We may use and share data that has been aggregated or de-identified (information that no longer identifies you or any individual user) for purposes like analytics, research, and product improvement. Because this data no longer relates to an identifiable person, it is not treated as personal information under this policy.

Our commitment to data security

Pinby uses commercially reasonable safeguards to preserve the integrity and security of your information. This includes encryption in transit, access controls, and limiting employee access to data. We cannot, however, ensure or warrant the security of any information you transmit to Pinby. Using unsecured wifi or unprotected networks is not recommended. If Pinby learns of a security breach, we may attempt to notify you electronically so you can take appropriate protective steps.

Our commitment to the privacy of children

Pinby is not intended for children under 13 and we do not knowingly collect personal information from anyone under 13. If you are under the age of majority in your jurisdiction, you may only use Pinby with permission from a parent or legal guardian. If you believe a child under 13 has provided information to us, please contact us at contact@pinby.app and we will delete it.

Information for individuals in Switzerland, UK, and the EEA

If you use Pinby while in Switzerland, the United Kingdom, or the European Economic Area (EEA), you have a number of rights, including:

• the right to access, update, or delete the personal information we have collected
• the right to rectify any personal information that may be inaccurate or incomplete
• the right to object to any processing of your personal information
• the right to restrict the processing of your personal information
• the right to be provided with a copy of your personal data in a structured, machine-readable, and commonly used format
• the right to withdraw consent at any time where we rely on your consent to process your personal information

In order to exercise any of these rights, please email us at contact@pinby.app. We may require proof of your identity before responding to any request.

When we process your personal data, we only do so under the following legal bases:

• As necessary to perform our responsibilities under our contract with you, like providing the products and services you have requested
• When we have a legitimate interest in processing your personal data, including to communicate with you about changes to Pinby, to help secure and improve Pinby, and to analyze usage of Pinby
• As necessary to comply with our legal obligations
• When we have your consent

Pinby is operated from the United States, and your personal data is processed there. When you use Pinby from the EEA, UK, or Switzerland, we transfer your data to the US under the Standard Contractual Clauses adopted by the European Commission (and the UK International Data Transfer Addendum where applicable). These clauses are also incorporated into our agreements with the sub-processors that help us operate Pinby. You can request information about these safeguards by emailing us at contact@pinby.app.

You have the right to file a complaint regarding our data protection practices with a supervisory authority. For more information, please contact your local data protection authority.

Information for California residents

If you are a California resident, the California Consumer Privacy Act as amended by the California Privacy Rights Act gives you a number of rights, including:

• the right to know what categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collecting it, and the categories of third parties with whom we share it
• the right to access the personal information we have collected
• the right to correct inaccurate personal information we maintain about you
• the right to delete personal information we have collected from you
• the right to opt out of the sale or sharing of your personal information for cross-context behavioral advertising
• the right to limit our use and disclosure of sensitive personal information
• the right not to be discriminated against for exercising any of these rights

We do not sell your personal information. With your consent, we may share limited advertising identifiers with advertising partners so we can measure the performance of our marketing and reach people likely to enjoy Pinby. You can revoke permission at any time in your device settings, or by opting out directly in Pinby's settings.

To exercise any of these rights, please email us at contact@pinby.app. We may require proof of your identity before responding. You may also designate an authorized agent to make a request on your behalf.

In the event of merger, sale, or bankruptcy

In the event that Pinby, LLC is acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected from our Pinby users as part of such merger, acquisition, sale, or change in control. In the (hopefully unlikely!) event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your information is treated, transferred, or used.

Changes to this Privacy Policy

We may change this policy from time to time. If you continue to use Pinby after any changes are in effect, you agree to the revised policy. If the changes are material, we will provide a more prominent notice or seek your consent to the new policy.
